Terms of Service
Section 01 — Acceptance of Terms
These Terms of Service ("Terms") govern your access to and use of the DetailOps platform, website, and services ("Services") operated by DetailOps ("Company", "we", "us", "our").
By creating a DetailOps account, clicking "I agree", or using our Services, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you are using DetailOps on behalf of a business, you represent that you have authority to bind that business to these Terms.
If you do not agree to these Terms, do not use our Services.
You must be 18 or older to use DetailOps. By agreeing to these Terms, you confirm you are at least 18 years of age.
Section 02 — The Platform
DetailOps is a software-as-a-service (SaaS) platform that provides auto detailing businesses with tools including:
- A branded online booking page for client self-booking
- Appointment scheduling and calendar management
- Client relationship management (CRM) and history tracking
- Payment processing via Stripe integration
- Automated SMS and email reminders
- Business analytics and reporting
We reserve the right to modify, suspend, or discontinue any feature of the platform at any time. We will provide reasonable notice of material changes where possible.
Section 03 — Accounts & Registration
To use DetailOps, you must create an account. You agree to:
- Provide accurate, current, and complete information during registration
- Maintain and promptly update your account information
- Keep your password secure and confidential
- Notify us immediately of any unauthorized use of your account
- Accept responsibility for all activity that occurs under your account
You may not share your account credentials with others or create accounts for the purpose of abuse, fraud, or circumventing platform restrictions.
We reserve the right to suspend or terminate accounts that violate these Terms, contain inaccurate information, or engage in fraudulent activity.
Section 04 — Subscriptions & Billing
DetailOps is offered on a subscription basis. By subscribing, you agree to the following:
- Free Trial: New accounts receive a 14-day free trial with full access to all features. No credit card is required to start a trial. After the trial period, continued use requires a paid subscription.
- Billing: Subscriptions are billed monthly or annually in advance. All prices are in Canadian dollars (CAD) unless otherwise stated. Applicable taxes (HST/GST) will be added at checkout.
- Auto-renewal: Subscriptions automatically renew at the end of each billing period. You may cancel at any time to prevent renewal.
- Refunds: Monthly subscriptions are non-refundable once the billing period has started. Annual subscriptions may be eligible for a pro-rated refund within the first 30 days. Contact us at support@detailops.com for refund requests.
- Price changes: We reserve the right to change subscription pricing. We will provide at least 30 days' notice of any price increase via email. Your continued use after the notice period constitutes acceptance of the new pricing.
- Founding member pricing: If you subscribed at a promotional "founding member" rate, that rate is locked in for the life of your subscription as long as it remains active without a break in service.
Section 05 — Payments & Stripe Integration
DetailOps uses Stripe to facilitate payment processing between you (the detailer) and your clients. By connecting a Stripe account, you agree to Stripe's Terms of Service and Stripe's Connected Account Agreement.
Important payment terms:
- Payments from your clients go directly to your connected Stripe account
- DetailOps does not hold, control, or have access to your Stripe funds at any point
- DetailOps is not responsible for Stripe outages, payment failures, or fund holds by Stripe
- Refund and dispute policies between you and your clients are your responsibility
- You are responsible for setting appropriate deposit policies and communicating them to clients
- DetailOps subscription fees are charged separately and are not related to client payment flows
Chargebacks and disputes between you and your clients are handled directly through Stripe. DetailOps is not a party to those transactions and cannot intervene in disputes between detailers and their clients.
Section 06 — Acceptable Use
You agree to use DetailOps only for lawful purposes related to operating a legitimate auto detailing business. You must not:
- Use the platform for any illegal activity or to violate any applicable law
- Upload false, misleading, or fraudulent business information
- Collect payments for services you do not intend to provide
- Use DetailOps to spam, harass, or contact individuals without their consent
- Attempt to hack, reverse-engineer, or disrupt the platform
- Resell or sublicense access to the DetailOps platform
- Import client data you do not have the right to use
- Use the platform in a way that could damage our reputation or that of other users
Violation of this section may result in immediate account suspension without refund.
Section 07 — Your Data
You retain ownership of all data you input into DetailOps, including your business information, client records, and booking data ("Your Data").
By using DetailOps, you grant us a limited, non-exclusive license to store, process, and display Your Data solely for the purpose of providing the Services to you.
We will not access, use, or share Your Data except as described in our Privacy Policy or as required by law.
Data export: You may export your data at any time through the platform settings. Upon account termination, we will provide a data export for 90 days before permanently deleting your data.
Client data responsibility: You are responsible for ensuring you have the legal right to collect and store your clients' personal information in DetailOps, and for complying with applicable privacy laws in your interactions with your clients.
Section 08 — Platform Disclaimer
DetailOps is a software platform only. We are not an employer, staffing agency, or party to any service transaction between detailers and their clients.
- DetailOps does not employ, endorse, or warrant any detailer using the platform
- DetailOps is not responsible for the quality, safety, or legality of detailing services provided through the platform
- DetailOps is not liable for any disputes, damages, or losses arising from transactions between detailers and their clients
- Detailers are independent business operators and are solely responsible for their own business operations, taxes, licensing, and insurance
If you are a client booking through a DetailOps-powered booking page, your agreement is with the individual detailing business — not with DetailOps.
Section 09 — Intellectual Property
The DetailOps platform, including its software, design, logos, trademarks, and content ("DetailOps IP"), is owned by DetailOps and protected by Canadian and international intellectual property laws.
You may not copy, modify, distribute, sell, or create derivative works from any DetailOps IP without our express written permission.
You retain all rights to your own business content (your logo, business name, service descriptions) uploaded to the platform. By uploading content, you confirm you have the rights to use it.
Section 10 — Limitation of Liability
DetailOps is provided "as is" without warranties of any kind, express or implied. We do not warrant that the platform will be error-free, uninterrupted, or meet your specific requirements.
To the maximum extent permitted by applicable law:
- DetailOps shall not be liable for any indirect, incidental, special, or consequential damages
- Our total liability to you for any claim arising from use of the platform shall not exceed the amount you paid to us in the 3 months preceding the claim
- We are not liable for data loss, missed bookings, or revenue lost due to platform downtime
- We are not liable for any actions taken by Stripe or other third-party service providers
Some provinces do not allow the exclusion of certain warranties or limitations of liability. In such cases, the above limitations apply to the fullest extent permitted by law.
Section 11 — Termination
By you: You may cancel your subscription and delete your account at any time through the account settings page. Cancellation takes effect at the end of the current billing period.
By us: We reserve the right to suspend or terminate your account at any time for:
- Violation of these Terms
- Non-payment of subscription fees
- Fraudulent, abusive, or illegal activity
- Extended inactivity (12+ months) with prior notice
In cases of serious violation (fraud, illegal activity), termination may be immediate without notice or refund. In other cases, we will provide at least 7 days' notice.
Upon termination, your access to the platform will cease and your booking page will be deactivated. Your data will be retained for 90 days after which it will be permanently deleted.
Section 12 — Disputes & Governing Law
These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of law principles.
Before initiating formal legal proceedings, you agree to contact us at legal@detailops.com and attempt to resolve the dispute informally for at least 30 days.
Any disputes that cannot be resolved informally shall be submitted to binding arbitration in Toronto, Ontario, under the Arbitration Act of Ontario. The decision of the arbitrator shall be final and binding.
Notwithstanding the above, either party may seek injunctive or other equitable relief from a court of competent jurisdiction in Ontario.
Section 13 — Changes to Terms
We reserve the right to update these Terms at any time. When we make material changes, we will:
- Update the "Last Updated" date at the top of this page
- Send an email notification to all registered users at least 14 days before changes take effect
- Display a notice within the DetailOps platform
Your continued use of DetailOps after the effective date of the revised Terms constitutes acceptance. If you do not agree to the changes, you must stop using the platform and cancel your account before the changes take effect.
